Job Purpose


To formulate the Contract Management tactical plan related to Supplier Relationship Management, Contract Risk Management and the general principles of contract articulation, promotion and execution by facilitating negotiations & dispute resolutions of procurement agreements and provide support in the procurement of goods & services.


Education and Experience

Minimum Qualification & Experience Required


LLB, Supply Chain Management, BCom or other relevant Honours / Postgraduate Diploma (NQF 8) AND 10-12 years' experience in a Procurement environment, of which 3 - 4 years at middle management level.


ALTERNATIVE #


LLB, Supply Chain Management, BCom or relevant Bachelor's Degree / Advanced Diploma (NQF 7) AND 12 - 15 years related experience in a Procurement environment, of which 3 - 4 years at middle management level.

Process


Causing for an efficient Drafting and Vetting of Contracts entered in by SARS Procurement pertaining to all procurement and matters incidental thereto.
Causing for Drafting amendments to contracts where necessary and reviewing Contract and Corporate Governance Requirements in conjunction with Corporate Legal.
Design and executive contracts execution engagement sessions with all key parties during the implementation of the contracts and implement the contractor performance visibility and reporting mechanism.
Develop tactical strategy and delivery plans in support of functional objectives in partnership with leadership.
Develop the Contract Management Framework with SARS as well as the alignment of the Contract
Management practices to the National Treasury Contracts Management Framework.
Direct, control, coordinate and optimise budgeted resources to meet specific objectives and deliver agreed results and productivity requirements.
Ensure alignment to local and international best practices and regulatory developments which may affect the manner in which SARS procurement approaches its Procurement practices and making appropriate recommendations.
Ensure the development and implementation of multiple practices in alignment with operational policy and procedural frameworks.
Identify and recommend opportunities to continuously improve all functions and systems in line with national, regional, and organisational changes.
Influence negotiations pursued by SARS Procurement by providing contracts inputs.
Leading periodic contract reviews with the objective of ensuring that a consistent practice is being followed in respect of the management of such contracts as well as the execution thereof.
Liaising with Corporate Legal on the appointment of External Service Providers (legal) where necessary and applicable and provide support during litigation matters to Attorneys/Advocates in conjunction with Corporate Legal.
Obtaining memberships of relevant national and international bodies, publications and attending seminars as required to ensure that procurement is kept abreast of development in the Contract Advisory and Contract Management field.
Operationalising the Contracts Advisory and Management Unit to be in alignment with the prevailing regulatory and legislative framework together with the changes in the application of the law.
Optimise the management of contracts across SARS by creating an electronic document management system backed up by a physical document management system that meets SARS wide records management policies and procedures.
Plan for handling work outputs, pull together interdependent activities and specify priorities, standards and procedures to ensure tactical excellence.
Proactively identify interconnected problems, determine its impact and use to develop best fit alternatives, driving best practice solutions.
Provide Contract Management Service by ensuring that appropriate advise and opinions are provided on all contractual, regulatory and legislative matters affecting SARS Procurement.
Provide periodic reports on performance against plan and progress on medium-term initiatives and use to realign operating plan and objectives appropriately.
Recommend changes to optimise processes, systems, policies and procedures, and direct the implementation of change and innovation initiated by the organisation.
Representing procurement at various interfaces between the various government departments and SARS on contract related matters including but not limited to National Treasury, Construction Industry Development Board, etc.
Timeously communicate top-down policy modification, objective achievement progress and critical success factors to impacted stakeholders.
Use the insights gained through integrated business reports to measure success and realign tactical strategy development objectives appropriately.
